NEP National Education Policy 2020 Implementation plan for New set up of AP Schools AMENDMENTS TO THE ANDHRA PRADESH RIGHT OF CHILDREN TO FREE AND COMPULSORY EDUCATION RULES, 2010 G.O.Ms.No.85, School Education (Prog.II),24th December, 2021
In exercise of the powers conferred by sub-section (1) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Act No.35 of 2009), the Government of Andhra Pradesh hereby makes the following amendments to the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010 issued in G.O.Ms.No.20, School Education (PE-Progs.1) Department, dated: 03.03.2011, as subsequently amended from time to time:
AMENDMENTS
In the said Rules:
1. In rule 3, in sub-rule (1),
(1) for clause (11), the following shall be substituted, namely: “(11). ‘ECCE’ means Early Childhood Care and Education to be run by Women Development & Child Welfare Department in the premises of Foundational/ Foundational Plus schools or as satellite foundational schools to provide pre-school education to the children in the age group of 3-5 years.”.
( ii) for clause (12), the following shall be substituted, namely:
“(12) ‘Elementary School’ means a school that imparts. education between classes I and class VIII. It includes all existing schools in Andhra Pradesh, namely, Foundational, Foundational Plus, Pre High schools and High Schools having these classes.”
(iii) for clause (18), the following shall be substituted, namely:
“(18) Neighborhood area of a school’ means the habitations in a safe walking distance of 1 km for a Foundational/ Foundational plus School, 3 kms for an Pre High School /High School having classes III to VIII.”
(iv) for clause (20), the following shall be substituted, namely:
“(20) (a) ‘Satellite Foundational School means All stand alone Anganwadi Centers and AWCs beyond 1 KM distance. (to the nearest foundational schools) that imparts education for PP1 & PP2.
(b) ‘Foundational School’ means a school that imparts education for PP1,PP2, Class 1 & 2.
(c) ‘Foundational Plus School’ means a school that imparts education for PP1, PP2, Classes 1 to 5.
(d) ‘Pre High School’ means school that imparts education for Classes 3 to 7/8.”
2. In rule 5,
(1) in sub-rule (1), for clause (c), the following shall be substituted, namely:
“(c). Transport allowance shall be provided to the children within the age group of 6 to 14 years where there is no availability of Foundational/Foundational plus School (I to II/V classes) within a radius of 1 (one) kilometer.”
(ii) in sub-rule (1), for clause (d), the following shall be substituted, namely:
“(d). Transport allowance shall be provided to the children where there is no availability of Pre High School (III to VIII classes) within a radius of 3 (three) kilometers.”
(i) for sub-rule (2), the following shall be substituted, namely:
“(2) Wherever required, the State Government shall upgrade existing Foundational Plus schools with classes PP1 to Class 5 by adding classes VI-VIII and in case of existing Pre High School having classes III-VII by adding class VIII.
3. In rule 7, in sub-rule (4), for clause (c), the following shall be substituted, namely:
“(c) Satellite Foundational/ Foundational/Foundational Plus School that the child has attended (upto age six) or attending.”
4. In rule 10, for sub-rule (3), the following shall be substituted, namely:
“(3) There shall be a committee at the state level comprising Secretary Finance, Principal Secretary/Secretary School Education, Commissioner/Director of School Education, Director, Women Development & Child Welfare, State Project Director, Samagra Shiksha and a representative of private school managements as nominated by their association, and representatives of two prominent NGOs, nominated by the Government for the purpose of assessing per child expenditure incurred by the state and the local. authority for reimbursement of expenditure to the schools under sub-section (2) of section 12 of the Act.”
5. In rule 19, in sub-rule (1),
(i) for clause (b), the following shall be substituted, namely:
“(b) The school having both Foundational/Foundational Plus school and Pre-high school shall have one Parents Committee for the entire school.”
(ii) for clause (c), the following shall be substituted, namely:-
(c) In case of schools having classes from PP1 to 10 for both foundational/foundational plus/ Pre High School and High schools there shall be one Parent Committee for entire school.”
(iii) for clause (d), the following shall be substituted, namely: “(d) The Parents Committee once constituted shall exist. perpetually until its abolition or merger, to be authorized by the Mandal Education Officer in case of Foundational/Foundational Plus Schools and Pre-High School and the DEO in case of other schools. However members will retire as per their terms. The resultant cyclical and casual vacancies shall be filled within reasonable time as prescribed by the Implementation Authority.”
6. In rule 28, for sub-rule (2), the following shall be substituted, namely:
“(2) The Minister for Education shall be the ex-officio Chairperson of the Council.”
7. In rule 28, for sub-rule (5), the following shall be substituted, namely:
” (5) Principal Secretary to Government School Education shall be the convener of the council. The Secretary, Tribal Welfare, the Secretary, Social Welfare, the Secretary, BC Welfare, the Secretary, Minority Welfare, the Secretary, Women & Child Welfare, the Secretary, HM&FW, the Secretary, Panchayat Raj shall be special invitees to the meetings of the Council. One member each of the recognized teachers unions who are members of Joint Staff Council shall be the special invitees
8. In Appendix, in Form I,-
(1) for table (G)(1), the following shall be substituted, namely:
“(G)(1)Teachers in Foundational/ Foundational Plus School”
(ii) for table (G)(2), the following shall be substituted, namely:
“(G)(2) Teachers in Pre High School”
