Aided Schools : Payment of Maintenance Grant – Certain Instructions issued

Sub:- School Education-Aided –Payment of Maintenance Grant – Certain
Instructions issued – Regarding.

The attention of all the District Educational Officers in the state IS invited
to the reference read above a number of proposals are being received from them
for release of maintenance grant for the private aided management schools
functioning under their jurisdiction. But the proposals are not furnishing any
factual data about the maintenance of the institutions nor justifying the need. 

2. In this regard, it is hereby clarified that a private-unaided school is primarily
a private school receiving certain grant in aid and the school gets recognition
provided it fulfills the norms as prescribed under Section 19 of the Right To
Education Act and the section is as follows:

19 (1) No school shall be established or recognized under section 18
unless it fulfills the norms and standards as specified in the schedule. 

(2) Where a school established before the commencement before the
commencement of this Act does not fulfill the norms and standards specified in the schedule, it shall take up steps to fulfill such norms and
standards at its own expenses within a period of three years from the date
of such commencement. 

(3) Where a school fails to fulfill the norms and standards within the
prescribed specified under sub section (2), the authority prescribed under
sub section (1) of section 18 shall withdraw recognition granted to such
school in the manner specified under section (3) thereof.

 (4) With effect from the date of withdrawal of recognition under sub
section (3) no school shall continue to function. 

(5) Any person who continues top run a school after the recognition is
withdrawn shall be liable to fine which may extend to one lakh rupees and
in case of continuing contraventions to a fne of ten thousand rupees for
each day during which such contravention continues


3. The above section of the Right To Education Act, 2..9 read with Rule 14 of
the Rules issued vide GO Ms.No. 2., School Education (PE-Progs.I) .department
dated 3-3-2.11 (as notified in Gazette No.1. dated 5-3-2.11) mandates that the
private aided/unaided schools have to fulfill the norms at their own expenses
within (3) years from the date of enactment of the Act. In case of private aided
schools, the grant in aid released by government consists of two components a)
teacher salary for teachers @ 1:4. students, and b) maintenance grant ed to
support a private aided educational institution in their efforts to provide a
congenial environment for the children to prosecute their studies.

4. In view of the above, whenever a private aided management requests for release of maintenance grant the .District Education Officer has to verify whether
the management has fulfilled the norms and conditions for running the school as
per Section 19 of RTE Act and Rule 14 of the Rules. A management without
adhering to the norms under RTE stands liable de-recognition and liable for fine if
still continues to run without fulfilling the norms. 

5. Further, in case of the private aided managements that have fulfilled the
norms and seeking sanction of maintenance grant, the .district Education Officer
has to verify whether the management furnished their annual administration
report under Rule 2. of G.O.Ms.No.1, Education, dated.1-1-1994, by 3.th
September at the least. Such report shall be supported by the audited statement
of accounts of the school duly audited by the Chartered Accountants. Separate
accounts shall be maintained for each school. Similarly the educational agency
which is running more than one school shall also submit such returns within the
stipulated time to the competent authority. 

6. In view of the above, whenever any private aided management requests
for release of maintenance grant the .district Educational Officers in the state are
requested to verify:
a) whether the Educational agency is adhering to the norms and standards as
prescribed under section 19 of the RTE, 2..9 and the Rule 14 of RTE Rules,
b) if the norms are fulfilled, then verify whether Administrative report as above
for the academic years or not. For example for the academic year 2.18-19 the
report shall be submitted by 3.-9-2.19. If not submitted the school within the
stipulated time it is not eligible for maintenance grant for the academic year
2.18-19 and like other years also.

7. If the management fails to fulfill the norms, action should be taken as per
Section 19 of the RTE and Rule 14 of the Rules under RTE, and if the
management fails to submit the annual administrative reports within the
stipulated time, the claims shall be rejected by way of a speaking order. Only
those claims of the managements that have fulfilled the norms as per Section 19
of RTE read with Rule 14 and that have submitted the annual administration
reports within stipulated time shall be submitted to Director, School Education for
further action.
